Terms of Service

Welcome to Ride, an app by Moove Apps PTY LTD ("we", "us", "our"). By accessing or using Ride, you agree to these Terms of Service ("Terms"). If you do not agree, do not use Ride.
Your consumer rights. Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, right or remedy you have under the consumer-protection laws of your country of residence, where those laws cannot be excluded by agreement. Where any provision of these Terms conflicts with such a law, that law prevails and the provision applies only to the extent permitted. This paragraph governs the whole of these Terms, including sections 3, 10 and 13.
1. Our Services
Ride uses your phone’s GPS and sensors to track your cycling activities. We provide features like route recording, performance metrics, personal activity logs, and social interactions with other users. Some advanced features require a paid subscription. We may update or modify our Services at any time.
2. Eligibility and Accounts
- You must be at least 13 years old or meet the minimum age in your country to use Ride.
- If you are under the age of majority, a parent or guardian must accept these Terms on your behalf.
- You are responsible for all activity under your account. Keep your password confidential and secure.
- We reserve the right to refuse service, suspend, or terminate accounts at our discretion where there is a breach of these Terms or applicable law.
3. Subscriptions and Billing
Some features of Ride require an active subscription:
- Subscription fees are charged in advance and may change over time. We will notify you of any fee changes before they apply.
- Your subscription will auto-renew unless you cancel. Cancellation takes effect at the end of the current billing cycle.
- Purchases made through the App Store are refunded by Apple, under Apple's refund policy. We do not process those refunds. To request one, contact Apple.
- Where the law of your country gives you a right to withdraw from a purchase — for example the 14-day withdrawal right in the EEA and the United Kingdom, or the seven-day right under Brazilian consumer law — that right applies in addition to this section.
- You are responsible for providing valid payment information and keeping it up to date.
4. Content and Intellectual Property
You own the content you create and share on Ride, such as ride data, photos, and comments. By posting, you grant us a non-exclusive, worldwide license to use, display, and distribute your content as needed to operate and improve the Services.
5. Privacy and Data
Our Privacy Policy explains how we collect, use, and protect your data. By using Ride, you consent to our data practices as described there.
6. Acceptable Use
- Do not post unlawful, harmful, harassing, or offensive content.
- Do not engage in activities that harm, disrupt, or otherwise misuse our Services or the community.
- We may remove content or suspend accounts for violations of these Terms or applicable law.
7. Social and Community Features
Ride allows you to follow, comment on, and interact with other users. Use common sense and respect when engaging with others. We are not responsible for the conduct of other users, or for the accuracy or legality of the content they post.
If you believe content on Ride is unlawful or breaches these Terms, you can report it to us at [email protected]. We review reports promptly, tell you what we have decided and why, and explain how you can challenge that decision.
8. Third-Party Services
Ride may link to or integrate with third-party products or services. We do not endorse or control these third parties. Your interactions with them are at your own risk, and their terms and privacy policies apply to you separately.
9. Health and Safety
Ride does not provide medical or professional advice. Consult a qualified professional before starting or modifying any exercise program. Cycling involves risks, and you assume full responsibility for your activities. Always follow safety guidelines and obey local laws.
10. Disclaimers and Limitation of Liability
We provide Ride "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our total liability to you will not exceed the greater of USD$50 or the amount you paid in the previous 12 months.
This section is subject to Your consumer rights above. In particular, it does not exclude or limit the consumer guarantees given by the Australian Consumer Law, or any equivalent guarantee under the law of your country of residence that cannot be excluded by agreement.
11. Indemnification
You agree to indemnify Moove Apps PTY LTD from claims arising out of your content, use of Ride, or breach of these Terms.
12. Termination
We may suspend or terminate your account for violations of these Terms or applicable laws. Upon termination, some rights and licenses granted to you end immediately. Sections regarding intellectual property, disclaimers, and liability survive termination.
13. Governing Law and Dispute Resolution
These Terms are governed by Australian law, without regard to conflict of laws principles. Any disputes will be resolved by the courts located in Australia, unless local law provides otherwise.
If you are a consumer, this does not deprive you of the protection of the mandatory law of your country of residence, and you may bring proceedings in the courts of that country where its law gives you that right.
14. Changes to These Terms
We may update these Terms periodically. If we make material changes, we will notify you. Continued use after changes indicates acceptance of the updated Terms.
These Terms represent the entire agreement between you and Moove Apps PTY LTD regarding Ride. If any part of these Terms is found invalid, the remaining provisions remain in effect. Your use of Ride confirms your acceptance.
